P. v. Bloom CA1/2
A jury convicted defendant Gerald Bloom of multiple counts of committing lewd acts upon two victims under the age of 14. On appeal, defendant argues: (1) the trial court erred in failing to instruct, on its own initiative, on the defense of unconsciousness and (2) insufficient evidence supported an order requiring him to submit to HIV/AIDS testing. The People dispute the first point, but concede the second point. We reverse the HIV/AIDS
