P. v. Hale CA2/4
After defendant Dequan Hale’s motions for mental health diversion (Pen. Code,1 § 1001.35 et seq.) and developmental disability diversion (§ 1001.20 et seq.) were denied, he pleaded no contest to unlawful firearm activity. Hale appeals, arguing the trial court erred in denying his requests for diversion. We conclude the court abused its discretion in denying each request. We conditionally reverse and remand for the court to reconsider
