P. v. Ruth CA2/5
I. INTRODUCTION Defendant Kendrick Ruth appeals from a judgment of conviction following a limited remand. He argues the trial court erred in failing to declare sua sponte a doubt about his mental competence prior to sentencing him and abused its discretion by denying him mental health diversion. He also makes four claims of sentencing error. We find no error in the court’s failure to declare a doubt as to defendant’s competency or abuse
