Defendant contends he never waived his right to be present, and the court’s error was prejudicial. For the reasons post, we agree the court erred by denying the petition without defendant’s presence at an evidentiary hearing. Because the error was not harmless beyond a reasonable doubt, we reverse the order and remand for further proceedings consistent with this opinion.
