The City and County of San Francisco (the City) ran a program providing downpayment assistance to qualified homebuyers, and in 2007, appellant Kayla Garcia took advantage of that program to help her buy a property. In exchange for the City’s assistance, Garcia promised that on sale of the property she would repay the City the amount advanced plus a percentage of the appreciated value of the property.
