-ooOoo- Real party in interest Andres Lyndell Jackson, a defendant in a criminal action, moved for pretrial mental health diversion pursuant to Penal Code1 section 1001.36. The People then filed a request to have Jackson submit to an examination by a prosecution- retained mental health expert pursuant to section 1054.3, subdivision (b). The Stanislaus County Superior Court denied the People’s request and later granted Jackson’s motion.
