P. v. Lewis CA3
Defendant Corey Lewis1 appeals the trial court’s denial of his application for pretrial mental health diversion. He contends the court abused its discretion by denying diversion because its finding that he is ineligible for diversion is not supported by substantial evidence. We agree. Accordingly, we conditionally reverse and remand with instructions for the trial court to reconsider defendant’s application for mental health diversion.
