P. v. Burkhart CA2/7
Harry Burkhart appeals from a judgment of conviction entered after a jury found him guilty of multiple counts of arson and related offenses. After a bifurcated trial on Burkhart’s sanity, the jury found Burkhart was sane when he set the fires. Burkhart’s sole contention on appeal is that substantial evidence does not support the trial court’s finding that he was not eligible for mental health diversion under Penal Code section 1001.36.1
