On October 21, 2003, the People filed an information charging Defendant Daniel Lee Johnson with two counts of robbery (Pen. Code, § 211;1 counts 1 & 3) and one count of attempted robbery (§§ 664, 211; count 2). The People also alleged two previous robbery convictions under section 211 as felony strikes. On June 25, 2004, Johnson was tried in a court trial and found guilty on count 1 for robbery while being acquitted on counts 2 and 3. O
