P. v. Pena CA2/1
Rudy Alberto Pena pleaded no contest to one count of stalking with a temporary restraining order in effect and one count of attempting to dissuade a witness. The trial court sentenced him to four years in prison. Pena obtained a certificate of probable cause and appealed from the judgment. He contends the trial court abused its discretion by denying his pre-plea motion for mental health diversion, pursuant to Penal Code1 section 1001.36
