P. v. Harris
Defendant Ivory Montel Harris appeals a judgment of conviction following a jury trial in which he was convicted of first degree murder based on his participation in a gang-related drive-by shooting.
On appeal, Harris contends that there is insufficient evidence to establish that he was involved in the drive-by shooting, since no eyewitness placed him inside the vehicle involved in the shooting at the time of the incident. Harris also contends that the trial court erred in admitting certain portions of a gang expert's testimony. According to Harris, the trial court allowed the gang expert to give improper opinion testimony as to Harris's guilt.
We conclude that there is substantial evidence to support the jury's guilty verdict. We further conclude that the trial court properly admitted the gang expert's testimony, and that the gang expert did not usurp the jury's fact-finding function, as Harris contends. We therefore affirm the judgment.
