P. v. Sweet
Appellant Clinton Sweet, Jr., appeals from an order denying his motion to recalculate his presentence custody credits. Counsel also informed appellant that he had the right to file a supplemental brief on his own behalf. Appellant declined to exercise that right.
Appellant was convicted by a jury of petty theft with a prior. (Pen. Code, § 666.)[1] On March 25, 2009, the court sentenced him to two years in prison. As is relevant here, the court granted appellant 214 days actual credit plus 106 days conduct credit for a total of 320 days.
