P. v. Baker
Defendant Cody Angus Baker[1] appeals the sentence imposed following his convictions for four counts of vehicular manslaughter while intoxicated (Pen. Code, § 191.5, subd. (b)), one count of driving under the influence of alcohol and causing injury (Veh. Code, § 23153, subd. (a)), and one count of driving with a blood-alcohol content over .08 percent and causing injury (Veh. Code, § 23153, subd. (b)). As to each of the felony driving under the influence charges, the jury found true a multiple-victim enhancement. Defendant contends the trial court erred in imposing a three-year sentence on the multiple-victim enhancement, given that he was also sentenced on each manslaughter conviction. The People properly concede the error.
