Doe v. Lyddon
Plaintiff Jane Doe appeals the judgment entered after the trial court granted defendant John Arthur Lyddons motion for summary judgment on plaintiffs complaint alleging defendant transmitted herpes to her. She contends defendant failed to carry his initial burden on summary judgment. Court agree and reverse on that basis. Accordingly, Court need not address plaintiffs remaining contentions that she submitted evidence demonstrating the existence of a triable issue of material fact and that court should have continued the hearing to allow her to obtain and test blood samples.
