P. v. Pasillas
A jury found Adrian Pasillas and Jorge Lopez guilty of two counts of assault with a deadly weapon (Pen. Code, 245, subd. (a)(1)),[1](counts 1 & 2). The jury also found that both Pasillas and Lopez committed counts 1 and 2 for the benefit of a criminal street gang ( 186.22, subd. (b)(1)). The court sentenced Pasillas to eight years in prison, consisting of the middle term of three years on count 1, plus an additional term of five years for the gang enhancement. The court imposed an identical eight-year sentence as to count 2, and ordered that the sentence on count 2 run concurrently with the sentence to count 1. The trial court placed Lopez on formal probation for a period of three years.
