P. v. Lee
Anthony Bernard Lee appeals a judgment following his jury convictions of one count of transporting cocaine base (Health & Saf. Code, 11352, subd. (a)) and one count of possessing cocaine base for sale (Health & Saf. Code, 11351.5). The jury also found true allegations he had five prison prior convictions (Pen. Code, 667.5, subd. (b), 668). On appeal, Lee contends: (1) the trial court erred by denying his request to represent himself; (2) there is insufficient evidence to support a finding he served prison time for one of the section 667.5, subdivision (b), prison prior allegations; and (3) the trial court erred by instructing with a version of CALCRIM No. 220 because it did not instruct that the People must prove each element of the charged offenses beyond a reasonable doubt.
