P. v. Sims
Defendant Ray Dell Sims was convicted of the 1974 first degree murder of 15-year-old Elizabeth Ortega. He appeals, claiming it was prejudicial error for the trial court to instruct the jury with the standards for evaluating circumstantial evidence of culpable mental states (CALCRIM No. 225) without also instructing the jury concerning the evaluation of circumstantial evidence in general (CALCRIM No. 224). In addition, he asserts the trial court erred when it denied his request for a continuance of the motion for new trial and when it found that his pretrial statement was voluntary. Court affirm.
