Whitty v. Stone
In this action for legal malpractice, Frank Whitty, in propria persona, appeals a judgment of dismissal entered after the court granted Kenneth Stone's motion for nonsuit after Whitty's opening statement on the ground his claims required expert opinion and he failed to designate an expert. Whitty contends the nonsuit was improper because Stone's alleged errors and omissions were matters of common knowledge, and thus no expert testimony was required. He also contends the court erred by granting Stone summary adjudication of his complaint's cause of action for fraud. Court affirm the judgment.
