P. v. Suniga
Appellant Alfred Suniga III stands convicted, following a jury trial, of two counts of first degree murder, in each of which he personally used and intentionally discharged a firearm, causing death (Pen. Code, 187, subd. (a), 12022.5, subd. (a), 12022.53, subd. (d)). Pursuant to the jurys further finding of multiple-murder special circumstances (id., 190.2, subd. (a)(3)), the trial court sentenced him to consecutive terms of life in prison without the possibility of parole plus 25 years to life. He now appeals, raising various claims of trial and sentencing error. For the reasons that follow, Court will modify the judgment by striking one multiple murder special circumstance finding, but otherwise affirm.
