P. v. Comfort
Susannah Merlina Comfort stood trial on three counts arising from an armed robbery on November 19, 2004, directly perpetrated by John F. Makins, a codefendant whose case ultimately preceded hers. Comfort appeals following the imposition of a two-year prison term after a jury acquitted her of conspiracy to rob (count 1; Pen. Code, 182, subd. (a)(1), 211), but found her guilty of second degree robbery (count 2; 211, 212.5) and of being an accessory to the same robbery (count 3; 32, 211). She claims prohibited double-conviction, misinstruction on accessory liability, and sentencing error in denying probation. Court affirm the judgment.
