P. v. Perez
Defendant was convicted of the first degree murder of Cesar Cera, who was romantically involved with defendants ex-girlfriend. On appeal, defendant contends (1) the prosecutor committed misconduct by arguing in rebuttal that defense counsels argument for voluntary manslaughter was a concession of guilt; (2) the instruction on a witnesss prior criminal conduct misled the jury; and (3) defense counsel was ineffective because he failed to request an instruction on provocation reducing the degree of murder. Court affirm.
