P. v. Roberts
Defendant and appellant, Ronald Eugene Roberts, appeals from the judgment entered following his conviction, by jury trial, for attempted premeditated murder and robbery, with firearm use and gang enhancement findings (Pen. Code, 664/187, 211, 12022.53, 186.22, subd. (b)).[1] Roberts was sentenced to state prison for a term of 46 years and 6 months to life. In our original opinion, filed December 20, 2006, we affirmed Robertss convictions, but remanded to the trial court for resentencing because the trial court had committed several sentencing errors. On September 12, 2007, the California Supreme Court transferred the case back to us with directions to vacate our decision and reconsider the cause in light of People v. Black (2007) 41 Cal.4th 799 (Black II), and People v. Sandoval (2007) 41 Cal.4th 825. The judgment is affirmed in part, reversed in part, and remanded to the trial court.
