P. v. Nguyen
The People charged defendant Luong Nguyen with the murder of Bang Bui. His first trial resulted in an acquittal as to first degree murder, but the court declared a mistrial when the jury deadlocked on whether he was guilty of second degree murder or manslaughter. During deliberations at defendants second trial, the jury advised the court it was having difficulty reaching a verdict. After the trial court discussed the matter with the jurors in open court, they returned a verdict finding defendant guilty of second degree murder. Defendant appeals, contending the trial courts comments to the jury violated his right to due process. Finding no error, Court affirm the judgment.
