P. v. Herrera
Defendant Anthony Charles Herrera pleaded guilty to two counts of oral copulation with a minor under the age of 18 and one count of sexual intercourse also with a minor under the age of 18. (Pen. Code, 288a, subd. (b)(1), 261.5, subd. (c).)[1] The court suspended imposition of sentence for three years; placed defendant on probation on condition he spend one year in jail; imposed various fines and fees; and, over defendants objection, imposed a mandatory lifetime duty to register as a sex offender under section 290, subdivision (a)(1)(A).
On appeal from the judgment, defendant claims the court erred in finding that the duty to register was mandatory.
