Michael v. Smartparks-San Jose, Inc.
Plaintiff Theresa Michael seeks review of a summary judgment order entered in favor of defendant Smartparks-San Jose, Inc., in her action for injuries she sustained at Raging Waters, an amusement park owned and operated by defendant. Plaintiff argues that defendant was not entitled to summary judgment because there were triable issues of material fact as to whether her injuries were caused by a dangerous condition on defendant's property and whether defendant had notice of that condition. Court find no error and must therefore affirm the judgment.
