THE COURT:
The opinion filed in this case on November 23, 2009, is ordered modified as follows:
1. On page 2, the second full paragraph, after the amount of $297,801.31, add as footnote 2 the following footnote, which will require the renumbering of all subsequent footnotes:
2The court subsequently reduced the amount of this award to $172,748.11.
2. On page 14, the first sentence in the disposition, delete the amount of $297,801.31 and insert in its place and stead the amount of $172,748.11.
This modification does effect a change in the judgment. The petition for rehearing is denied.
