P.v. Pinto

Filed 2/10/06 P.v. Pinto CA3

NOT TO BE PUBLISHED

IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA

THIRD APPELLATE DISTRICT

(Yolo)

----

THE PEOPLE,

Plaintiff and Respondent,

v.

NINA MARIE PINTO,

Defendant and Appellant.

C048983

(Super. Ct. Nos. 955405, 955680, 957445, 959876)

After defendant Nina Marie Pinto admitted violating probation and her probation was revoked in each of these four cases (Yolo County Case Nos. 955405, 955680, 957445, and 959876), the court sentenced her to an aggregate prison sentence of five years.

Among the fines and fees it imposed at sentencing, the court imposed in each of the four cases a $200 parole revocation fine pursuant to Penal Code section 1202.45

On appeal, defendant contends that imposing Penal Code section 1202.45 fines in two of the four cases constitutes an impermissible ex post facto punishment because the crimes in those cases were committed prior to the enactment of the fine.
