IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA

SECOND APPELLATE DISTRICT

DIVISION SIX

THE PEOPLE,

Plaintiff and Respondent,

v.

SAUL SILVA,

Defendant and Appellant.

2d Crim. No. B209904

(Super. Ct. No. 2007029885)

(Ventura County)

Saul Silva appeals a judgment of conviction entered after he expressly waived his constitutional rights and pleaded guilty to two counts of assault with a firearm, and admitted that he personally used a firearm in committing the crimes and that he served a prior prison term. (Pen. Code, 245, subd. (a)(2), 12022.5, subd. (a), 667.5, subd. (b).) The trial court sentenced Lewis to seven years four months, and imposed a $1,400 restitution fine and a $1,400 parole revocation restitution fine. The trial court struck the prior prison term allegations and dismissed the charged count of possession of a firearm by a felon. ( 667.5, subd. (b), 12021, subd. (a)(1).) The trial court awarded Silva 57 days of presentence custody credits.

We appointed counsel to represent Silva in this appeal. After counsel's examination of the record, he filed an opening brief raising no issues.

On November 10, 2008, we advised Silva that he had 30 days within which to personally submit any contentions or issues that he wished to raise on appeal. We have not received a response from him.

We have reviewed the entire record and are satisfied that Silva's attorney has fully complied with his responsibilities and that no arguable issue exists. (People v. Wende (1979) 25 Cal.3d 436, 441.)

The judgment is affirmed.

NOT TO BE PUBLISHED.

GILBERT, P.J.

We concur:

COFFEE, J.

Bruce A. Clark, Judge
