COURT OF APPEAL, FOURTH APPELLATE DISTRICT
DIVISION ONE
STATE OF CALIFORNIA
THE PEOPLE, Plaintiff and Respondent, v. FERNANDO ORTEGA, Defendant and Appellant. | D050355 (Super. Ct. No. SCS207608) |
APPEAL from a judgment of the Superior Court of San Diego County, Robert J. Trentacosta, Judge. Affirmed.
Fernando Loya Ortega entered a negotiated guilty plea to inflicting corporal injury on the mother of his children (Pen. Code,[1] 273.5, subd. (a)) with infliction of great bodily injury ( 1192.7, subd. (c)(8)) and admitted a prior prison term ( 667.5, subd. (b)) and a strike ( 667, subds. (b)-(i), 668, 1170.12). The court sentenced him to prison for a stipulated term of six years (twice the middle term). Ortega appeals. We affirm.
FACTS
The change of plea form includes this factual basis for the plea: "[I] did willfully and unlawfully inflict injury towards Stephanie Symons who is the mother of my children and admit I personally inflicted great bodily injury against Stephanie Symons."
DISCUSSION
Appointed appellate counsel has filed a brief setting forth the evidence in the superior court. Counsel presents no argument for reversal but asks this court to review the record for error as mandated by People v. Wende (1979) 25 Cal.3d 436 and Anders v. California (1967) 386 U.S. 738.
We granted Ortega permission to file a brief on his own behalf. He has not responded. A review of the record pursuant to People v. Wende, supra, 25 Cal.3d 436 and Anders v. California, supra, 386 U.S. 738 has disclosed no reasonably arguable appellate issues. Ortega has been competently represented by counsel on this appeal.
DISPOSITION
The judgment is affirmed.
