Pursuant to a negotiated disposition, appellant Ronnie Hodge pled guilty to second degree burglary (Pen. Code, § 459) and on September 14, 2004, he was granted probation on certain terms and conditions. On June 22, 2005, the district attorney moved to revoke probation based upon appellant's arrest for another but unrelated second degree burglary. The district attorney declined to file new criminal charges and elected to proceed solely on the motion to revoke probation.
Hearing on the motion was held on August 19, 2005, at the conclusion of which the trial court found appellant in violation of probation and revoked probation. Appellant was sentenced to the low term of 16 months in state prison. The court also ordered the appellant â€
