IN THE COURT OF APPEAL OF THE STATE OF CALIFORNIA
SECOND APPELLATE DISTRICT
DIVISION EIGHT
THE PEOPLE, Plaintiff and Respondent, v. MARK LINNEAR HAYS, Defendant and Appellant. | B184347 (Los Angeles County Super. Ct. No. A196311) |
APPEAL from a judgment of the Superior Court of Los Angeles County.
Eric C. Taylor, Judge. Appeal dismissed.
Christine C. Shaver, under appointment by the Court of Appeal, for Defendant and Appellant.
Mark Linnear Hays, in pro. per., for Defendant and Appellant.
No appearance by Plaintiff and Respondent.
Mark Linnear Hays pled guilty to burglary and possession of a sawed-off shotgun. Division Two of this Court affirmed the conviction in 1983. In March 2005, the Superior Court denied two petitions for writ of habeas corpus filed by Hays. Hays purports to appeal from the denial of his petitions for writ of habeas corpus. However, the trial court's order denying a petition for writ of habeas corpus is not an appealable order. (In re Clark (1993) 5 Cal.4th 750, 767 fn. 7; Durdines v. Superior Court (1999) 76 Cal.App.4th 247, 250 fn. 5.)
DISPOSITION
The appeal is dismissed.
