On November 8, 2005, defendant, Gabino Aguilar Gonzalez, entered into a plea agreement under which he would receive a stipulated state prison sentence of 31 years 8 months. Pursuant to this agreement, he entered pleas of guilty to two counts of attempted murder (Pen. Code sections 664/187, subd. (a)) and admitted a personal use of firearm enhancement (Pen. Code section 12022.5, subd. (a)), a gang enhancement (Pen. Code section 186.22, subd. (b)(1)), and an allegation of personal infliction of great bodily injury (Pen. Code section 12022.7, subd. (a)). Other charges were dismissed. Defendant completed a waiver of rights form which included a waiver of the â€





Description Despite being convicted of several crimes, and despite a sentence of 31 years, counsel and the court agreed that there was no issues to be raise on appeal following a judgment and conviction for attempted murder with a personal use of firearm enhancement, a gang enhancement, and an allegation of personal infliction of great bodily injury.
