THE COURT:
It is ordered that the opinion filed herein on January 29, 2010, be modified as follows:
On page 3, the third, fourth and fifth sentences of the first paragraph in part I.B., starting with After a preliminary hearing, and ending with answer for homicide are deleted and the following sentence is inserted in their place:
After a preliminary hearing, Judge OMalley held Gideon to answer for the
murder charge set out in the complaint.
There is no substantive change in the judgment.
