Petitioner provided this court with the wrong superior court case number. Accordingly, the nonpublished opinion filed in this court on February 25, 2008, is modified as follows:
1. On page 1, in the caption, the number 06-40546 is deleted and the number MCR026997 is inserted in its place.
2. On page 2, in the last paragraph, the number 06-40546 is deleted and the number MCR026997 is inserted in its place. The paragraph should now read:
Let a writ of habeas corpus issue directing the Clerk of Madera County Superior Court, if he receives said notice on or before 30 days from the date of this notice, to file said document in Madera County Superior Court action No. MCR026997, to deem said notice to be timely filed in said action, and to cause the normal record on appeal to be prepared in accordance with the applicable rules of the California Rules of Court.
