THE COURT:
It is ordered that the unpublished opinion filed herein on January 23, 2008, be modified as follows:
In the last sentence of the first full paragraph on page 5, the phrase Edmundson relied is substituted for the phrase Reed relied on. The sentence as corrected now reads: In short, there is no evidence that Edmundson relied, or should have relied, on any of these documents in deciding to appeal directly to the Commission rather than first appealing to the Board.
There is no change in the judgment.
Appellants petition for rehearing is denied.
