P. v. Lopez
Defendant and appellant Vincent Lopez (defendant) was convicted of first degree murder (Pen. Code, § 187, subd. (a)[1]). On appeal, defendant contends that there is not substantial evidence to support the jury’s findings that he committed the crime for the benefit of the gang, and the trial court erred in imposing a 10-year section 186.22, subdivision (b)(1)(C) enhancement. We hold that there is sufficient evidence to support the jury’s findings that defendant committed the crime for the benefit of the gang, and that the trial court erred in imposing the 10-year section 186.22, subdivision (b)(1)(C) enhancement.
