P. v. Chen
A jury convicted defendant and appellant Jason Chen of first degree murder. Appellant contends (1) there is insufficient evidence of premeditation and deliberation to sustain his conviction, (2) the trial court erred by failing to instruct the jury on the lesser included offense of voluntary manslaughter based on sudden quarrel or heat of passion, and (3) the court erred further by refusing to instruct the jury that a witness testifying under a grant of immunity was an accomplice whose testimony should be viewed with caution. Court find no merit in any of these contentions and affirm.
