Yu v. Global Merchant Center
Plaintiffs Sofia Lu Yu, Candice Yu, Zhen Wang, and Jenny Jing Li Gong appeal an order staying this action on forum non conveniens grounds against defendants FCStone LLC (FCStone), Spike Trading, Inc. (Spike), MF Global, Inc., Pioneer Futures, Inc., Brian Suelzer and Bank of America pending resolution of a securities fraud action in the State of Illinois. Plaintiffs contend public policy prohibits the enforcement of the mandatory forum selection clause in their account agreements with defendants. Court affirm.
