P. v. Villalpando
Defendant Dennis Montoya Villalpando was convicted of various crimes arising from the home invasion robbery of his girlfriends mothers boyfriend. On appeal, he contends (1) the trial court erred by failing to instruct sua sponte on the defense of claim of right, (2) the trial court erred by failing to instruct sua sponte on the lesser included offense of robbery, and (3) the jurys acquittal of defendants codefendant resulted in inconsistent verdicts. Court will affirm.
