Malone v. Merle Norman Cosmetics
Plaintiff Mark Malone appeals the dismissal of his action for wrongful termination after the trial court sustained defendant Merle Norman Cosmetics (Merle Norman) demurrer to his second amended complaint without leave to amend. He contends he pleaded with sufficient specificity to withstand demurrer his claims for breach of implied contract, breach of oral contract, breach of the implied covenant of good faith and fair dealing, and wrongful termination in violation of public policy. We affirm the judgment dismissing Malones contract claims, but reverse judgment on his claim for wrongful termination in violation of public policy.
