P. v. Foster
Defendant Kenreid Cornell Foster was convicted after jury trial of two counts of aggravated sexual assault of a child under the age of 14 (Pen. Code, 269)[1] and three counts of forcible lewd conduct on a child ( 288, subd. (b)(1)). Defendant was sentenced to 48 years to life in prison.
On appeal, defendant contends that the trial court prejudicially abused its discretion when it denied his motion to continue sentencing so that he could investigate a motion for new trial. For reasons that Court will explain, Court determine that the court did not abuse its discretion and therefore Court will affirm the judgment.
