P. v. ONeill
On appeal, armed with a certificate of probable cause, defendant contends: (1) the trial court erred in denying his Marsden motion and that such denial resulted in an involuntary plea; (2) the trial court prejudicially abused its discretion in denying his postjudgment motion to withdraw his no contest plea; and (3) he was denied effective assistance of counsel guaranteed by the Sixth Amendment to the United States Constitution and article I, section 15, of the California Constitution. Court disagree with each contention and affirm the judgment.
