P. v. Fells
Edward Charles Fells appeals the judgment following his conviction for first degree murder (Pen. Code, 187/189) and attempted premeditated murder ( 664/187). The jury found true allegations that he personally discharged a firearm causing death and great bodily injury ( 12022.53, subds. (b), (c) & (d)), committed the offenses for the benefit of a street gang ( 186.22, subd. (b)(1)(B)), and served two prior prison terms ( 667.5, subd. (b)). He claims the trial court erred in the admission of evidence, denial of a motion for mistrial and motion to appoint counsel, and failure to rule on a motion for new trial. He also claims error in the computation of presentence custody credits. Court will order a correction in presentence credits. Otherwise, Court affirm.
