P. v. Real
Defendant Nicholas Real timely appealed from his convictions on two counts of assault with a firearm and one count of brandishing a firearm at a person in a motor vehicle. The jury found allegations that defendant personally used a firearm true but found the gang allegations to be not true. The court sentenced defendant to nine years and four months. Defendant contends there was insufficient evidence that the object he was holding in his hand during the charged incident was a firearm and, if there was, there was insufficient evidence the firearm was loaded. Court affirm as modified.
