Kudsk Construction v. Moraga-Orinda Fire Dist.
This appeal follows an order by the trial court which sustained defendants demurrer to plaintiffs first amended complaint for breach of contract, without leave to amend and entered of judgment in favor of defendant. Plaintiff claims that the court erred by finding that the action is barred by the lapse of the one-year statute of limitations to file a government claim. Court conclude that plaintiff did not file its government claim with defendant within one year of the accrual of the breach of contract action, and affirm the judgment.
