P. v. Orta
Uriel Orta appeals from the judgment entered after a jury convicted him of first degree felony murder, contending the jury should have been instructed to consider theories of second degree murder and voluntary manslaughter. Court hold that such instructions were not warranted by the evidence, and, alternatively, that the failure to give them was harmless error. Accordingly, and because other asserted grounds for reversal are without merit, Court affirm the judgment.
