P. v. Banuelos
Defendant George Banuelos appeals from his conviction of second degree murder (Pen. Code, 187) with an enhancement for personally discharging a firearm in commission of the crime (Pen. Code, 12022.53). He raises three issues on appeal: improper admission of lay opinion evidence, ineffective representation by his attorney because of the failure of counsel to request an instruction on the theory of defense of others, and lack of substantial evidence to support a restitution order. Finding no reversible error, Court affirm the judgment.
