P. v. Davis
Defendant and appellant Brandon Davis appeals from the denial of a motion to withdraw his guilty plea. He asserts that the trial court abused its discretion because he established good cause for the withdrawal pursuant to Penal Code section 1018 by showing that he suffered from a mental deficiency rendering him unable to comprehend the consequences of his plea. He also claims that he received ineffective assistance of counsel in that his former attorney did not adequately communicate with him, failed to advise him to file either a motion to suppress or quash and did not file any defensive motions. Finally, he contends that the plea agreements provision permitting the prosecution to withdraw from the agreement should be construed reciprocally to apply to him. Court find no merit to these contentions and affirm the denial of the motion.
