P. v. Bosworth
Defendant pleaded guilty to second degree robbery (Pen. Code, 211, 212.5, subd. (c)) and admitted having suffered a prior strike ( 667, subds. (b)-(i), 1170.12) and a prior serious felony conviction ( 667, subd. (a)) for robbery. The trial court denied defendants request to strike the strike and sentenced him to nine years in prison. On appeal, defendant contends that the court abused its discretion and denied him due process when it refused to strike the strike. For reasons that Court explain, Court affirm the judgment.
