P. v. Esquivel
A jury found defendant Sal Esquivel guilty of forcible rape and sustained an aggravated kidnapping allegation. Defendant was sentenced to 25 years to life. On appeal, defendant contends there was insufficient evidence of asportation to support the aggravated kidnapping enhancement and the court failed to instruct on an aider and abettor liability as it related to the enhancement.
